1. Using the Website

Malungelo Properties provides this website to share information about its student accommodation, properties, facilities and application process. You may use the website only for lawful purposes and must not interfere with its security, operation or availability.

Information and photographs are provided to help applicants understand the accommodation. We try to keep website information accurate and current, but availability, room features and other details may change.

2. Application Process

When you submit an application, you must provide information that is accurate, complete and current to the best of your knowledge. This includes your contact details, identity information, institution, student status, funding information, accommodation preferences and emergency contact information.

Materially false, misleading or incomplete information may result in an application being declined or an allocation being withdrawn where this is reasonable and lawful.

If you are under 18 or otherwise do not have full legal capacity to enter into an accommodation agreement, a parent, guardian or other legally authorised person may need to participate in the contracting process.

3. Accommodation and Room Allocation

Submitting an application does not guarantee accommodation. Allocation is subject to availability, application approval, the relevant property requirements and completion of any further steps communicated to you.

We will try to consider your selected property and room type, but Malungelo Properties cannot guarantee a specific room, building position or preference unless it is confirmed in writing.

4. Fees, Deposits and Payment

Any application fee, deposit, rental amount, service charge or other accommodation fee that applies will be communicated to you before it becomes payable and, where applicable, will be recorded in your written offer or accommodation agreement.

You are responsible for making payments by the due dates stated in the applicable written agreement. Malungelo Properties will not treat a fee as payable merely because it appears on this website unless it has been properly communicated as part of your application or accommodation arrangement.

5. Withdrawals, Cancellations and Refunds

You may withdraw an application by contacting Malungelo Properties in writing. Once accommodation has been accepted or a written agreement has been signed, cancellation rights, notice periods and any reasonable charges will depend on the applicable agreement and South African law.

Please read the Cancellation Policy before accepting accommodation.

6. Residence Conduct

If you are accepted for accommodation, you must comply with the Residence Rules, reasonable safety and security requirements, and any property-specific house rules provided to you. Serious or repeated breaches may be dealt with in accordance with the accommodation agreement and applicable law.

7. Privacy and Personal Information

Malungelo Properties processes applicant and resident personal information for accommodation related purposes. Details about the information collected, why it is used, service providers, retention, security and your rights are explained in the Privacy Policy.

Consent given for processing an accommodation application is not treated as consent to receive unrelated direct marketing.

8. Electronic Communications

By providing an email address or phone number, you agree that Malungelo Properties may contact you electronically about your application, accommodation, documents, payments, notices, maintenance, emergencies and other matters directly related to the accommodation relationship.

Important communications may be sent by email, phone call, SMS or WhatsApp using the contact details you provide. You are responsible for keeping those details up to date.

9. Third Party Services and Links

The website may use or link to third party services for forms, automation, hosting, maps, fonts, icons or other website functions. Those providers may have their own terms and privacy practices. Malungelo Properties is not responsible for third party websites that you choose to visit.

10. Intellectual Property

Unless otherwise stated, the Malungelo Properties name, website design, original text, photographs and other original website material belong to Malungelo Properties or are used with permission. You may not copy, republish or commercially exploit that material without permission, except where the law allows it.

11. Availability and Liability

We aim to keep the website available and accurate, but uninterrupted access cannot be guaranteed. To the extent permitted by law, Malungelo Properties is not responsible for losses caused solely by temporary website unavailability, third-party service failures or information supplied by third parties.

Nothing in these Terms excludes or limits any right or remedy that cannot lawfully be excluded under South African law.

These Terms are governed by the laws of the Republic of South Africa. Any accommodation-specific dispute will also be subject to the applicable written accommodation agreement and any statutory dispute-resolution rights available to the parties.
